“Enai Noki Paayum Thotta” is a movie that has been directed by Gautham Vasudev Menon and star-cast by Dhanush in the lead role. The movie which is ready for release for more than a year is struggling due to financial disputes. The reason behind the movie getting unreleased is because of the Interim Injunction availed by the producers of the movie “Bhahubali 2” M/s.Arka Media Works. Records show that S.N.Rajarajan of K Productions had failed to honour the payment pending to Arka Media Works pertaining to “Bhahubali 2” and hence Arka Media Works had approached the Hon’ble court seeking justice in this regard.
Few month ago Arka Media Works had availed an Interim Injunction restaring anyone from releasing the movie Sindhubadh & Ennai Nokki Paayum Thotta, since S.N.Rajarajan was directly or indirectly involved in production of these movies. Sindhubadh was later taken over by a different company and Vijay Sethupathi had made a request with Arka Media Works and a part payment was settled by one of the producers of Sindhubadh. But the status-quo order of restaring the release of the movie Enai Noki Paayum Thotta continues till date.
In the mean-time, the director of the movie Gautham Vasudev Menon ande producers of the movie Escape Artistes Motion Picture have approached Ishari Ganesh, Producer who owns Vels Film International, one of the biggest production houses in Tamil Industry to release the movie Enai Noki Paayum Thotta. Ishari Ganesh knowingly or un-knowingly about the complications regarding the financial disputes of Enai Noki Paayum, Arka Media, S.N.Rajarajan and Escape Artistes Motion Pictures, he had accepted to release the movie.
Vels Film International has been advertising the release date of the movie as November 29 on all social media platforms and daily newspapers. Trade players have good-will on Vels Film International and had assumed that the financial dispute regarding Ennai Nokki Paayum Thotta has been resolved. Arka Media Works who came to know about the release date publicities carried out by Vels Film Internationa has now sent a “Public Notice” to Trade Players, Digital Platforms, Satelitte Channels and other film traders not to enter into any agreement of trade in releasing the movie “Enai Noki Paayum Thotta”, since there is a status-quo order pending in the Hob’ble High Court of Hyderabad.
The “Public Notice” issued by Ms. Pujitha Gorantla, counsel for Arka Media Works is as mentioned below:
This is to inform to all that M/s K Productions represented by sole- proprietor Mr Rajarajan, Having its office at FI & F2, 3 Floor, GKS, Annex Pycrofts Garden Road, Thousand Lights, Chennai, Tamil Nadu 600 006 and having its office at No. 7, 5h Avenue, Harrington Road,Chetpet, Chennai – 600 031, Tamil Nadu owes an amount of Rs 17,60,00,000 (Rs. 17.60 crore as on 31.07.2018) to M/s Arka Media Works (hereinafter “My Client) (a limited liability partnership firm, having its office at registered Office at Plot No. 89/ 90/ B 4th floor, Ashoka Vishnu Capitol, Annapurna Studios Lane, Road No.2, Banjara Hills, Hyderabad-50003) towards amounts payable towards purchase of exploitation rights of the feature film Baahubali The Conclusion. That vide its order dated 19.02.2019 in C.O.P, No. 93 of 2018 (filed by my client). the Hon’ble XXIVth Additional Chief Judge Cum Commercial Court, City Civil Court, Hyderabad, was pleased to direct M/s K Productions and M/s Rajarajan to furnish sccurity for an amount of Rs. 17.60 crore,, within one week from the date of the order, failing which, the bank account of M/s K. Productions stands attached. That M/s K Productions and M/s Rajarajan have failed to comply with the said order and have failed to furnish security. That, subsequently, my Client M/s Arka Media Works was constrained to file C.O.P. No. 29 of 2019 before the Hon’ble XXIVth Additional Chief Judge Cum Commercial Court, City Civil Court, Hyderabad, seeking, inter-alia, an injunction from releasing/ and appropriating in any manner the revenue arising from the feature films titled: i. “Ennai Nokki Paayum Thota” in Tamil language (Film 3), starring Dhanush Megha Akash and others; i. “Sindubaadh” in Tamil language, starring starring Vijay Sethupathy and Anjali except after obtaining no objection/no dues certificate from the Petitioner; The Hon’ble XXIVth Additional Chief Judge Cum Commercial Court, City Civil Court Hyderabad, vide its its ex-parte ad-interim order dated 09.04.2019 in C.O.P. No. 29 of 2019, was pleased to grant an injunction restraining M/s K Productions, M/s Rajarajan and M/s Espace Artists Association from entering into any business transaction for sale of satellite and digital rights of movies “Ennai Nokki Paayum Thota (Film 3) and Sindhubaadh. Subsequently, C.O.P. No. 29 of 2019 was dismissed by the Hon’ble XXIVth Additional Chief Judge Cum Commercial Court, City Civil Court, Hyderabad vide its docket order dated 04.05.2019 (a copy of which is yet to be available) While so, an appeal has been filed against the order dated 04.05.2019 in C.O.P. No. 29 of 2019, vide COMCA No. 27 of 2019, before the Hon’ble High Court at Hyderabad. The Hon’ble High Court, vide its interim order dated 08.05.2019, while issuing notice to M/s K.Productions, Mr. Rajarajan and M/s Escape Artists Motion Pictures, was pleased to grant status quo orders. This notice is to put all trade players and the general public on notice to not to enter into any business transactions with M/s K Productions, M/s Rajarajan and M/s Escape Artists Association represented by Mr. P. Madan for sale of any of the rights, including satellite digital, distribution, theatrical rights of the movie “Ennai Nokki Paavum Thota (Film 3) Further, “Ennai Nokki Paayum Thota (Film 3) cannot be released in any mode/ medium/ format, anywhere in the world, pending the status-quo orders passed by the Hon’ble High Court at Hyderabad in COMCA No. 27 of 2019. A copy of the status report of the Hon’ble High Court showing COMCA No. 27 of 2019 as pending is also enclosed for ready reference.
