Media Association named in Latha Rajnikanth’s affidavit seems to be unscrupulous! Police complaint filed!!

An Injunction order was issued in December 2014, in favour of Latha Rajnikanth, wife of Superstar Rajnikanth by the Principal City Civil and Sessions Judge. The same court one hearing a application filed by M/s.Ad Bureau Advertising Private Ltd., and few other defendants examined the case and issued an order that the interim order dated 2.12.2014 stands dissolved or vacated or discontinued.

The affidavit filed by the Counsel of Latha Rajnikanth had mentioned that she had received a letter from “The Publishers and Broadcasters Welfare Association of India” and it states as mentioned below:

“We act on behalf of all the media companies and concerns of India as they are our members. We act for their welfare and protection of their rights in the country. We also act as forwarding agency in respect of news feeds from various persons/entities and disburse it among our members.

One M/s Ad Bureau Advertising Pvt. Limited, No. 781, 1st Floor Royala Towers, Anna Salai, Chindatripet, Opposite LIC Subway, Chennai – 6000 002 has written to us by alleging against you that they were cheated by you in connection with some financial transaction arising out of distribution of Kochadaian cinema and has requested us to forward the news to all our media members.

We thought it wise to seek explanation from your good-self we could circulate the news contents and therefore, we request you to give us details pertaining to the said transaction and matter within 3 days, which would equip us better. Otherwise we shall presume that the allegation is correct and we would pass on the matter for publication.”

Ad Bureau Advertising Private Ltd., in O.S.No. 9312/2014 has also filed IA u/o.39 R4 of CPC to vacate interim order against him and submitted written statement as, “The company has not written letter dated 28.11.2014 to defendant No.76. This letter is created to suit the suit.”. Defendant No. 76 is none other than “The Publishers and Broadcasters Welfare Association of India” which is being blamed as unscrupulous, devious, unidentified person by Ad Bureau Advertising Private Ltd.

In regard to this, Mr. Abirchand Nahar, Chairman and Managing Director of Ad Bureau Advertising Private Ltd., has filed a complaint with the Police. Abirchand Nahar has sent a written complaint to, The Commissioner of Police, Bangalore City Police via Speed Post on 13th January 2015 stating that an Interim order had been passed against their company and 76 media on the basis of a letter dated 28.11.2014 filed in the court documents.

The complaint reads as, “The letter is written by unscrupulous, devious, unidentified person masking his identity as the secretary of some unknown association namely “The Publishers and Broadcasters Welfare Association of India” Press Club, Bangalore. The letter is dated 28.11.2014 and is addressed to Smt Latha Rajinikanth.”.

The complaint also states that the person has attempted to mislead and deceive the Honourable Court and 77 others by writing a false, phony, artificial and bogus letter, pretending to be Secretary of some unidentified association.

The complaint also added that Ad Bureau Advertising Private Ltd., had not written any such letter to any such Press Club Bangalore. The complainant has also requested the Police Department to investigate the matter and let them know where that association is and who is the signatory. complainant has also demanded Punishment under cheating by impersonation u/s. 419 IPC, to be punished with imprisonment and fine.
